Terms of Service

1. Acceptance of Terms

By downloading, installing or using the PEGGA application, you agree to be bound by these Terms of Service. If you do not agree with these Terms, you should not use the application.

These Terms constitute a legal agreement between you and Toralle Lda, a company registered in Guimarães, Portugal (hereinafter "Toralle").

2. Service Description

PEGGA is a productivity tool designed for ride-hailing (TVDE) drivers in Portugal. The application provides:

• Real-time analysis of ride proposals from Uber and Bolt platforms, via Accessibility Service and OCR
• Profitability calculations (€/km and €/hour)
• 4 types of intelligent goal alerts (daily, weekly, monthly and per ride)
• Shift management and productivity statistics
• Document expiry tracking with expiration alerts
• Dashcam functionality for safety
• Unified alerts center

3. Eligibility

To use PEGGA, you must:

• Be at least 18 years of age
• Be a licensed TVDE driver or in the process of obtaining a TVDE license
• Have a compatible Android device (Android 8.0 or higher)
• Comply with all applicable laws and regulations in your jurisdiction

4. Accessibility Service

PEGGA requires Android's Accessibility Service permission to function. By enabling this permission, you acknowledge that:

• The service reads screen content only from Uber and Bolt apps to analyze ride proposals
• No personal data is collected through this service
• The service does not click, tap, or modify any content on screen
• No screen content is transmitted to external servers
• You can revoke this permission at any time in Android settings

5. User Responsibilities

By using PEGGA, you agree to:

• Safe use: Never interact with the application while driving. Use PEGGA only when your vehicle is safely parked
• Legal compliance: Use the application in compliance with all traffic laws, TVDE regulations, and platform terms of service
• Accurate information: Provide accurate information when using the application's features
• No misuse: Not attempt to reverse engineer, modify, decompile, or misuse the application
• Independent decisions: Make your own decisions about which rides to accept. PEGGA provides information to assist your decision-making but does not make decisions for you

6. Accuracy Disclaimer

PEGGA uses OCR (Optical Character Recognition) technology to read ride proposals. While Toralle strives for maximum accuracy:

• OCR readings may occasionally contain errors
• Profitability calculations are estimates based on available on-screen data
• The application does not account for all possible costs (tolls, fuel variations, vehicle wear, etc.)
• You are responsible for your own decision to accept or reject rides
• Past results do not guarantee future results

7. Subscriptions and Payments

• Free trial: 7 days with full access to all features
• Subscriptions: Monthly and yearly plans available via Google Play billing
• Auto-renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period
• Cancellation: Cancel anytime via Google Play Store → Payments & subscriptions → Subscriptions → PEGGA → Cancel
• Refunds: Handled by Google Play according to their refund policy
• Partner fleets: Drivers in Veiklo/TVDE Smart partner fleets may have access at no additional cost while the partnership is active

All prices are displayed in Euros (€) and include VAT where applicable. Toralle reserves the right to adjust subscription prices, notifying users with reasonable advance notice.

8. Intellectual Property

The PEGGA application, including its code, design, graphics, logos, icons, and content, is the exclusive property of Toralle Lda and is protected by Portuguese and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, and revocable license to use the application for personal purposes. You may not:

• Copy, modify, distribute, or create derivative works from the application
• Reverse engineer, decompile, or attempt to extract the source code
• Use the PEGGA name, logo, or brand without written authorization from Toralle
• Sell, rent, sublicense, or transfer the usage license
• Use the application for commercial purposes without authorization

9. Privacy and Data

User privacy is a priority. The Privacy Policy describes in detail how PEGGA handles data.

Key points:

• All ride data is processed and stored exclusively on the user's device
• Toralle does not collect or transmit personal data to external servers (except Veiklo validation)
• You retain full control over your data and can delete it at any time
• You can request Veiklo server data deletion at pegga.app/delete-account

10. Limitation of Liability

PEGGA is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, Toralle shall not be liable for:

• Financial losses resulting from ride acceptance or rejection decisions
• Inaccurate OCR readings or incorrect profitability calculations
• Service interruptions or application unavailability
• Changes to the Uber or Bolt platforms that may affect PEGGA's functionality
• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Actions taken by Uber, Bolt, or other platforms regarding the user's account

11. Third-Party Services

PEGGA interacts with third-party services (Uber, Bolt) but Toralle is not responsible for:

• The terms, policies, or practices of these platforms
• Changes these platforms may make that could affect PEGGA's functionality
• Any disputes between you and these platforms

Your use of Uber and Bolt is governed by the respective terms of service of those platforms.

12. Updates and Changes

Toralle may update the application and these Terms from time to time. Significant changes will be communicated through the application or the website pegga.app. Continued use of the application after changes constitutes acceptance of the new Terms.

13. Termination

You may stop using PEGGA at any time by uninstalling the application. Toralle reserves the right to suspend or terminate access to the application if you violate these Terms or engage in activities harmful to the service or other users.

In case of termination, you can delete all local data by uninstalling the application and request Veiklo data deletion at pegga.app/delete-account.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Portugal. Any disputes shall be submitted to the courts of Guimarães, Portugal, without prejudice to any mandatory consumer protection laws applicable in your jurisdiction.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a competent court, the remaining provisions shall continue in full force and effect.
